Learned advocate for the petitioner submits that because of mis-communication he was absent on 16th October, 2023 and the learned special court was pleased to issue warrant of arrest. Thereafter, being afraid of the circumstances, he did not appear before the court. The petitioner was earlier granted bail by this court in CRM(NDPS) 309 of 2022 and there was a condition that he should appear before the trial court on each and every date. The approach of the petitioner although is not acceptable but he should be granted an opportunity. As such I direct that in case the petitioner appears and surrenders before the learned special court under the NDPS Act cum learned Additional Sessions Judge, 3rd court, Asansol, Paschim Bardhaman in connection with Sessions Trial No. 04 of 2022 by 15th March, 2024, he may be allowed to continue on the same bail but should furnish a fresh bond of

similar amount as was directed by the Hon'ble Division Bench. A fresh condition is imposed upon the petitioner that he shall not leave the jurisdiction of Kulti PS without the permission of the learned special court except for the purposes of attending the court. Petitioner shall meet the Inspector-in-Charge/Officer-inCharge of the Kulti PS once a week till further modification is made by the learned special court.

Report so submitted on behalf of the State be kept with the record.

With the aforesaid observations, the revisional application being CRR 104 of 2024 is disposed of.
