The petitioner is in custody since 24th February, 2023. According to the petitioner, investigation has been concluded, charge-sheet has been submitted and the next date has been fixed for hearing on 12th March, 2024 for consideration of charges.
The learned trial court is directed to overcome the stage of consideration of charge on 12th March, 2024 or within a fortnight thereafter. After overcoming such stage if the learned Special Court is of the opinion that the trial is to be progressed in that case the learned trial court would thereafter fix a schedule consisting of three dates, and fix such schedule once in every month so that the trial of the case is taken to its logical conclusion within a reasonable period of time, keeping in mind that there are 12 witnesses to be examined. No unnecessary adjournment be given to either
of the parties. The jurisdictional Superintendent of Police will take steps if any information is sent by the learned trial court for ensuring the presence of the witness concerned. The learned Public Prosecutor conducting the case would produce the material documents and exhibits on the date so fixed for examination of the witnesses concerned. All stakeholders would cooperate the trial court to conclude the trial at the earliest.
With the aforesaid observations, CRR 4960 of 2023 is disposed of.
