Petitioner has preferred the present writ petition seeking a direction upon the respondent authority for providing an electricity connection in respect of his submersible pump situated at plot No.386 pertaining to Khatian No.630, Mouza: Uttar Ektarpur, J.L. No.136 3.

It is the case of the petitioner that he had applied for electricity connection for his submersible pump on 23.08.2023. The petitioner further contended that in the month of March, 2024, he was further advised for preferring an application since the earlier application was lost and/or misplaced and the subsequent application was duly received by the licensing company along with the certificate of trade license as well as necessary tax receipt belongs to the concerned Gram Panchayat. But till date no action has been taken on behalf of the respondent-WBSEDCL.

At the very outset, learned Advocate for the respondentWBSEDCL submits that the property in question falls within a critical zone as classified under prevailing environmental regulations. As such, in compliance with statutory norms, the

petitioner is mandatorily required to obtain a certificate from the State Water Investigation Directorate (SWID) prior to the grant of electricity connection for operating a submersible pump at the said premises. In absence of such SWID certificate the respondent WBSEDCL is unable to accede to the petitioner's request for granting new electricity connection. 5.

Learned Advocate for the petitioner submits that his client has already applied for a SWID certificate.

In view of the aforesaid submission made by the respondent-WBSEDCL, petitioner submits that he shall approach the respondent-WBSEDCL only after obtaining the SWID certificate along with other necessary documents. 7.

In view of the above, it is open to the petitioner to approach the respondent-WBSEDCL once he has obtained all the necessary documents including the SWID certificate. 8.

At this stage, learned Advocate for the petitioner submits that his client does not wish to press the present writ petition. 9.

Accordingly, the writ petition is dismissed as not pressed. 10.

There shall be no order as to costs.
