No. 29 CHC Rejected C.R.M.(A) 5722 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Asansol South Police Station Case No. 130 of 2022 dated 29.03.2022 corresponding to Special Case No.1 of 2023 under Sections 420/409/120B of the Indian Penal Code.
And In the matter of : Hari Narayan Burnwal & anr. ...... petitioners Mr. Agniv Sinha, Mr. Anno Roy Saraswati ....for the petitioners Mr. Saibal Bapuli, Ld. A.P.P.
Mrs. Trina Mitra ....for the State Petitioners pray for anticipatory bail.
The police case is dated March 29, 2022.
There is an issue of long absconsion.
Moreover, money taken from a bank is yet to be repaid. The transaction is not simpliciter of money lend an advance but also apparently involves criminal liability. Consequently, we are unable to grant anticipatory bail to the petitioners.
This application for anticipatory bail is, thus, rejected. CRM(A) 5722 of 2023 is disposed of.
