The subject matter of the case relates to Jalangi PS Case No.594 of 2009 and the said case was registered for investigation under Section 302 of the Indian Penal Code along with other relevant Sections. More than 14 years have passed and the charge till date has not been framed. Records reflect that in a designed manner the accused persons were evading the process of the court. Accordingly, henceforth it is directed that all the accused persons would once in a week till further orders of this court meet with the Inspector-in-Charge of the Jalangi Police Station.

Report reflects that the next date has been fixed on 3rd July, 2024. The Inspector-in-Charge of the Jalangi Police Station will ensure the appearance of all the accused persons.

The learned trial court is directed to expedite the process of framing of charges and take steps so that by 2nd week of August, 2024 charges are framed.

The learned trial court would thereafter fix a schedule consisting of three dates fixed for hearing once in every month so that the trial of the case is taken to its logical conclusion within the reasonable period of time. No unnecessary adjournment be given to either of the parties. In case any accused adopts methods or design to delay the trial, the learned trial court will not hesitate to cancel the bail. The jurisdictional Superintendent of Police will take steps if any information is sent by the learned trial court for ensuring the presence of the witness concerned who is essential for the just decision of the case.

The learned Public Prosecutor conducting the case would produce the material documents and exhibits on the date so fixed for examination of the witnesses concerned. All stakeholders would cooperate with the trial court to conclude the trial at the earliest. With the aforesaid observations, CRR 4959 of 2023 is disposed of.
