Mr. Soujanya Bandyopadhyay Ms. Babita Dey ......for the petitioner Mr. Kanak Kiran Bandyopadhyay .....for the State On hearing the learned counsel for both the parties and considering the materials on record it appears that the Controlling Authority under the Payment of Gratuity Act, Howrah vide an order dated 31st August 2022 directed payment of gratuity in respect of the petitioner herein.

Notice for payment was issued to the respondent company.

As the company did not comply with the same, a show cause notice dated 15.02.2023 was issued. Finally a certificate was issued on 16.03.2023 to the Certificate Officer and District Magistrate, Howrah for recovery of the said gratuity amount. Learned counsel for the State has placed documents to show that the Certificate Officer has proceeded in accordance with law and finally a warrant of arrest has been issued.

Accordingly, the writ application is disposed of with the direction that the Certificate Officer shall make all endeavour to dispose of the present proceedings before it within a period of 30 days from the date of this order.

Applications, if any, connected thereto stand disposed of consequently.

Interim order, if any, stands vacated.

Let a copy of this order be sent to the Certificate Officer, Howrah at once.

Photostat certified copy of this order, if applied for, being given to the parties on priority basis upon compliance of all formalities.
