29.12.2025 SR Rejected CRM (M) 2900 of 2025 In Re:- An application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita Act, 2023 filed in connection with Ekbalpore Police Station Case No.320 of 2020 dated 25.09.2020 under Sections 302 and 307 of the Indian Penal Court.

Ms. Sujata Das Ms. Suruchi Saha ... for the State.

Mr. Safdar Azam ... for the de facto complainant.

The petitioner herein prays for bail on the sole ground that the trial in the case is being delayed and he is in custody for five years and three months.

It is submitted by the learned counsel for the State that the Trial Court was vacant and at present there is a presiding officer, who has joined and next date has been fixed on 11th February, 2026.

This Court relying upon a judgment of the Supreme Court in Mamman Khan v. State of Haryana reported in 2025 INSC 1113 directs that the Trial Court shall prepone the date of trial and shall commence the trial in this case on and from 7th January, 2026, on day to day basis without grating any unnecessary adjournment to either sides and

make all endeavours to complete the trial expeditiously preferably within six months from the date of commencement of day to day trial.

Considering the heinous nature of crime in the present case, the prayer for bail is rejected.

Let a copy of this order be sent to the learned Trial Court for information.
