1. The petitioner herein prays for bail claiming parity with the other accused persons.
2. Learned counsel for the State submits that the petitioner herein has surrendered after proclamation and attachment was issued by the learned Trial Court. It is further submitted by the learned counsel for the State that there is clear evidence on record by which it is evident that the petitioner herein was in constant touch with the other accused persons to whom the ganja was delivered.
3. It appears that the petitioner is in custody since August, 2025 and charge-sheet was submitted earlier and that the petitioner,
though, after proclamation and attachment has surrendered voluntarily.
4. Considering the said facts and materials on record, the petitioner is also granted bail.
5. Accordingly, the application of bail is, thus, allowed.
6. I direct the petitioner be released on bail upon furnishing a bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of like amount each, one of whom must be a local, to the satisfaction of the learned Judge, Special Court, under NDPS Actcum-Additional Sessions Judge, 5th Court, Behrampore, Murshidabad. The petitioner shall appear before the trial court on each and every day of substantive hearing subject to the provisions of Section 317 of the Code of Criminal Procedure, 1973/Section 355 of the Bharatiya Nagarik Suraksha Sanhita, 2023 and shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever and the petitioner shall not leave the jurisdiction of the concerned Court without prior permission of the Court.
7. In the event, the petitioner fails to comply with any of the conditions as stated above, the learned Trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
8. Thus, the application for bail being C.R.M. (NDPS) 1737 of 2025 stands disposed of.
