Report submitted by the State reflects that the 04.03.2025 Court No. 35 Item No.9 Rakib writ petition has been preferred for possession, inspite of criminal cases pending inter se the parties.

Learned advocate appearing for the petitioner submits that the petitioner's grand-daughter is unable to enter her own house because of the resistance of the private respondents.

In view of the statutory remedies available under the law, I am of the view that it would not be fit and proper to invoke the jurisdiction under Article 226 of the Constitution of India. The writ petition has been preferred for circumventing the procedures of law. Petitioner, if so advised will approach the statutory Courts for appropriate remedy.

With the aforesaid observations WPA 28972 of 2023 is disposed of.

Report so submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
