1. By this application, the petitioner seeks expeditious disposal of the Misc. Appeal No.91 of 2021, which is pending before the learned Additional District Judge, Fast Track, 1st Court at Howrah.

2. Considering the submissions, the Court is of the view that the prayer of the petitioner is innocuous. Neither party stands to lose if a proceeding is disposed of expeditiously. In fact, such expeditious disposal shall enure to the benefit of the parties. Hence, there is no requirement for service of prior notice upon the opposite party.

3. Considering the fact that, the Statute requires disposal of such appeal preferably within a month, this revisional application is disposed of with a direction upon the learned court to dispose of the misc. appeal expeditiously, preferably within a period of four months from the next date fixed. Adequate opportunity shall be given to the parties to contest the same.

4. This court has not expressed any opinion on the merits of the misc. appeal. The learned court shall proceed independently and in accordance with law.

5. A copy of this revisional application along with a copy of this order be served upon the opposite party as also upon the learned advocate appearing on behalf of the opposite party in the learned trial court.

6. The revisional application is accordingly disposed of.

7. There shall be no order as to costs.
