Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners are the Assistant Teachers of the respondent school. As the Headmistress is retiring on 31st December, 2024, selection process was initiated for the post of Assistant Headmistress of the school. Four of the teachers applied for the post. But, the manner in which the proceeding was being conducted by the Headmistress made it abundantly clear that the Headmistress was trying to favour a particular candidate being the private respondent. In protest, the petitioner nos. 1 to 3 did not appear for the interview. They now want to vent their grievances before the District Inspector of Schools. To this effect, they have made a representation on 05.12.2024.

Learned counsel appearing on behalf of the State respondents denies the allegations and submits as follows. The petitioners do not have any locus to move this application. The first three petitioners applied for the post, but did not appear in the interview and the other petitioners did not even apply for the post. Besides, the panel has already been prepared on December 11, 2024. However, if a representation has been made before the D.I., the same may be considered in accordance with law.

In view of the above, let the concerned D.I. consider the representation of the petitioner in accordance with law and as expeditiously as possible, preferably within a period of eight weeks from the date of communication of this order. It is clarified that the merits of the case have not been gone into.

As affidavits were not called for, allegations contained in the writ petition are deemed not to have been admitted. Urgent Photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
