2026-02-02Hon'Ble Justice Jay Sengupta2 pages

02.02.2026 Sl. No.67 NB CRM (A) 107 of 2026 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Junput Coastal PS Case No.114/2025 dated 12.06.2025 under Sections 103(1)/3(5)/79/85 of the BNS, 2023 and Section 4 of the Dowry Prohibition Act.

And In the matter of: Sambhu Jana & Anr.

... petitioners Mr. Arup Kumar Bhowmick.

...for the petitioners.

Mr. Subhamoy Bhattacharya, Mr. Debarshi Brahma.

..for the State.

Learned counsel appearing on behalf of the petitioners submits that the petitioners are the son of the elder brother in law and another brother in law of the alleged victim. The marriage between the couple had taken place 9 years ago. The principal accused being the husband was arrested and thereafter granted bail. Some other coaccused were granted anticipatory bail. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He relies to the FIR and points to the specific allegations made against the present petitioners regarding indecent proposals and inappropriate behavior meted out against the victim. The neighbours have also taken the name of the petitioners, among others, as the miscreants.

Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected.

Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
