Ct.No.28 as (Rejected) C.R.M. (DB) 203 of 2024 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Golabari P.S. Case No.245 of 2014 dated 16.03.2014 under Sections 326/307 of the Indian Penal Code and charge sheet submitted under Sections 327/307/109/120B of the Indian Penal Code.
In the matter of : Harender Yadav.
... Petitioner.
Mr. Munshi Manzoor Hossain.
...for the Petitioner.
Mr. Sandip Chakraborty.
...for the State.
1.
Petitioner contends he was on bail earlier.
Thereafter, he was re-arrested and is in custody for more than six months. Accordingly, he prays for bail. 2.
Learned Advocate for the State opposes the bail prayer.
3.
We have considered the materials on record.
Conduct of the petitioner is not appreciable. He has absconded since 2017. There is possibility that he may again abscond, if released on bail.
4.
Hence, we are not inclined to grant bail to the petitioner.
5.
Accordingly, the prayer for bail of petitioner is rejected.
