Rakib (rejected) CRM (NDPS) 23 of 2026 In Re: An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/Under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Howrah GRPS Police Station Case no. 169 of 2025 dated 19.11.2025 under Sections 20(b)(ii)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned advocate appearing for the petitioners submits that intermediate quantity of contraband was recovered from the joint possession of the petitioners and they are in custody for more than two months.

Learned advocate for the State do not oppose the said contention of the present petitioners but submits that he is not in a position to apprise whether charge-sheet has been submitted in connection with the instant case. Having considered the submission of the State, I direct as follows:

(i) In case, the charge-sheet is submitted the learned Special Court would release the petitioners on bail on such terms and conditions as it deems fit and proper for ensuring

the future appearance of the accused/petitioners before the Court.

(ii) However this will not prevent the petitioners from exhausting the statutory rights vested within the ambit of the statute.

With the aforesaid observations CRM (NDPS) 23 of 2026 is disposed of.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
