Petitioners are in custody for more than three years. It is contended petitioner Nos.1 and 2 are women and no Fake Indian Currency Notes (for short FICNs) was from their possession. Accordingly, they pray for bail. 2.

Learned Public Prosecutor opposes the bail prayer. He contends petitioners were involved in funding terrorist activity. FICNs were recovered from one of the accused. Delay in the matter is due to systemic reasons and/or at the behest of the defence.

We have considered the materials on record. It is the prosecution case that petitioners were funding terrorist activity. Unaccounted cash was recovered from the possession of petitioner Nos.1 and 2. Large volume of

FICNs was recovered from the petitioner No.3. Trial has commenced. Delay in the matter is due to adjournments sought for on behalf of the defence or absence of Presiding Officer in Court. Prosecution cannot be said to be stack in the matter.

In view of the aforesaid gravity of the offence and the materials on record, we are not inclined to grant bail to the petitioners.

Accordingly, the prayer for bail of petitioners is rejected.

Trial Court is requested to expedite the trial and conclude the same at an early date without granting unnecessary adjournment to either of the parties. (Gaurang Kanth, J.) (Joymalya Bagchi, J.)
