Learned counsel for the respondent/State Public Information Officer, West Bengal Municipal Service Commission has handed over the reply of the RTI application filed by the petitioner.

Subsequent to the response received by the petitioner, he had filed second appeal before the West Bengal Information Commission under Section 19(3) of the RTI Act. It is stated by the

petitioner that same is pending adjudication before the appellate authority.

Since the petitioner has already preferred an appeal before the appellate authority, the present writ petition is misconceived and is not maintainable. The writ petition is dismissed without any cost.
