The petitioner is a retired Assistant Teacher of a school. He alleges that his arrear claim amounting to Rs.1,78,493/- for the period 1st August, 2002 to 30th November, 2019 is due and payable.

The petitioner submitted repeated representations before the respondent authorities but the same has not been taken up for consideration.

Prayer has been made to direct the District Inspector of Schools to consider the prayer of the petitioner for releasing his arrear claim.

Learned Advocate representing the District Inspector of Schools (Secondary Education), Purba Medinipur submits, on instruction, that the school authority submitted the arrear claim of the petitioner in the office of the Additional District Inspector of Schools (Secondary Education),
Contai Sub-Division without enclosing necessary papers in favour of the claim.

The Additional District Inspector of Schools, vide communicating letter dated 8th February, 2024, requested the school to submit the wanting documents. The same has not been supplied by the school till date.

The documents which are required were also intimated to the school authority with a copy marked to the petitioner.
copy of the communication dated 8th February, 2024 is handed over to the learned Advocate for the petitioner in Court today.

The school is not represented.

As the petitioner has already retired from service on 30th November, 2019, accordingly, the Court grants leave to the petitioner to forward the requisite documents as mentioned in the communicating letter dated 8th February, 2024 to the District Inspector of Schools for consideration of his claim for releasing arrear payment.

The claim of the petitioner shall be considered in accordance with law and if the same is found due then necessary steps for releasing the same shall be taken without any delay.

Steps shall be taken by the District Inspector of Schools at the earliest but positively within a period of eight weeks from the date of receipt of all
documents from the petitioner.

If the prayer of the petitioner is not found to be acceptable, the same shall be communicated to the petitioner with supporting reasons.

WPA 29011 of 2023 is disposed of.

Parties to act on the basis of the server copy of this order, duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
