Mr. Wasim Reza ...for the petitioner Ms. Sreemoyee Mitra ...for CESC Mr. Rittick Chowdhury ...for respondent no.4 The petitioner seeks an electricity connection for a shop room situated at premises no. 7, Rishi Bankim Chandra Road, Howrah - 711101.

Although an inspection was conducted by CESC for the purpose of providing the connection, it appears that, due to obstruction from respondent no. 4, the connection could not be effected.

Learned advocate appearing for the petitioner submits that the petitioner is in possession of the shop room in question. Learned advocate appearing for respondent no. 4, on the other hand, submits that the petitioner is neither the owner of the premises nor in possession of the said shop room.

This Court is of the view that there is no scope in the present proceeding to adjudicate the title of the petitioner in respect of the shop room.

If, upon inspection, CESC finds that the petitioner is in possession of the premises in question, I am of the view that the electricity connection in

favour of the petitioner ought to be effected, with police assistance from local police station, if necessary, within a period of two weeks from the date of this order. The cost of such police assistance shall be borne by the petitioner, who shall also comply with all requisite formalities.

The entire exercise shall be completed within a period of six weeks from the date of communication of this order.

Accordingly, WPA 30506 of 2024 is disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
