1. Learned senior counsel appearing for the petitioner submits as follows. On the particular day, the petitioner has been abducted and severely assaulted by the de-facto complainant and the others. He could not lodge the FIR in time as he was in hospital. He could lodged the FIR much later, after making a prayer before the learned Magistrate. The allegation in the present case against the petitioner is that one Sikha Biswas (since deceased) had given a power of attorney to the de-facto complainant and three others in respect of her property. It is alleged that subsequently and without revoking the earlier power of attorney, the present petitioner procured another power of attorney from the said person and sold the property to his wife. The earlier power of attorney had already been revoked by a registered deed.
2. Learned counsel appearing for the State opposes the prayer for anticipatory bail. However, she submits that the second power of attorney is a registered one.

Considering the above, the other materials available in the case diary, the allegations which also seem to have a civil profile and the fact that the power of attorney in question was a registered one, I do not think that custodial interrogation of the petitioner is required in this case and I am inclined to grant anticipatory bail to the petitioner.

In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioner shall cooperate with the investigation and shall not threaten or intimidate the witnesses. The petitioner shall meet the I.O once a fortnight till submission of report in final form.
5. Accordingly, the application for anticipatory bail is allowed.
6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
