Kausik (Rejected) CRM (M) 2921 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Jagaddal Police Station Case No. 323/2023 dated 10.08.2023 under Sections 366A/370/370A/372/373/120B of the Indian Penal Code, 1860, sections 3/4/5/6/7 of the Immoral Traffic (Prevention) Act, 1959 and Sections 6/17/21 of the POCSO Act, 2012.

Learned advocate appearing for the petitioner submits that petitioner is in custody for 2 years and 6 months and only part examination of one witness has been done.

Learned advocate for the State submits that there are 7 victims in the instant case and 6 victims are yet to be examined.

Having considered the period of detention of the present petitioner, I direct the learned Trial Court to at least conclude the evidence of all the victims by 31.05.2026. At

this stage, I am not inclined to release the petitioner on bail as all the vulnerable witnesses are to be examined. The petitioner will renew his prayer for bail after the evidence of these 6 child witnesses are over. Learned Special Court would prioritize the evidence of these 6 victims and put in efforts so that by 30th May, 2026 the evidence of all the victims are over. At this stage, CRM (M) 2921 of 2025 is dismissed. Report submitted by the State be kept with the record.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
