Kausik (Rejected) CRM (M) 35 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Pukhuria Police Station Case No. 302 of 2025 dated 18.06.2025 under Sections 103 of the BNS, 2023. Learned advocate appearing for the petitioner submits that petitioner is in custody for 5 months and charges have already been framed in connection with the instant case.

Learned advocate submits that initially it was the petitioner who lodged the complaint, took the victim to Hospital and subsequently he was implicated in the present case.

On the other hand, learned advocate for the State submits that the post-mortem report reflects that the case is homicidal. The brother of the deceased subsequently

complained regarding the nature of the dispute existing and thereafter the evidence surfaced regarding the alleged complicity of the present petitioner.

As charges have already been framed and the turning point of the present case related to materials claimed by the prosecution, being the evidence of CSW 12 and CSW 13, I am of the opinion that let the evidence of the CSW 12 and CSW 12 be completed on a priority basis, presumably within a period of 60 days.

Petitioner would approach this Court after the evidence of the said two witnesses are over.

At this stage, I am not inclined to release the petitioner on bail.

Accordingly, CRM (M) 35 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
