1. Petitioners herein claim bail on parity with accused Rejaul Ali who was granted bail by a co-ordinate Bench of this court on 17.9.2025 in CRM(NDPS) 825 of 2025.

2. It appears that the court considered the prayer for bail on the ground of delay in trial in view of the order of the Hon'ble Apex Court dated 19.2.2024.

It appears from the seizure list in respect of the present petitioners that recovery was made from the house of the petitioner no.1 and the following recovery was made: "(i) One scaled paper packet containing approx 1000 gram of light brown colour dry substance seems to be Morphine locally called crude kept in a plastic airtight pack marked as Exhibit-A (ii) One sealed paper packet containing approx 700 gram of light brown colour dry substance

seems to be heroin kept in a plastic airtight pack marked as Exhibit-B (iii) One sealed paper packet containing approx 1 kg of white colour dry substance seems to be alprazolam kept in a plastic airtight pack marked as Exhibit-C.

(iv) One scaled paper packet containing approx 1 kg of white colour dry substance seems to be powder kept in a plastic airtight pack marked as Exhibit-D.

(v) One scaled paper packet containing approx 5 kg of white colour dry substance namely Sodium Carbonate anhydrous SQ kept in a plastic airtight pack marked as Exhibit-E.

(vi) One sealed paper packet containing approx 5 kg of white colour dry substance namely Sodium Carbonate Anhydrous SQ kept in a plastic airtight pack marked as Exhibit-F.

(vii) 940 pcs of Rs 500 Indian Currency Notes - 4,70,000 and 15 pieces of Rs. 2000 Indian Currency Notes, total Rs 5 lakhs as sale proceed of manufactured contraband marked as Exhibit-G.

(viii) One electronic weighing machine of "Apple plus" company marked as Exhibit-H (ix) One iron made plastic punching machine of Sepack company marked as Exhibit-I"

4. Learned counsel for the petitioners at this stage submits that they are claiming parity regarding the detention period of the accused person with that of Rejaul Ali.

5. But considering the huge recovery made as noted above in the present case, this court finds that claim for parity cannot be sustained in this case and the prayer for bail is, thus, rejected.
