The present writ application has been preferred praying for direction upon the respondents to recover the amount of gratuity as granted by the Controlling authority in the Certificate Proceeding being No.G-05/2007 and certificate case No.4(M)-12-13.

None appears for either side in the present case.

It appears that the Controlling authority had passed an order on 18.10.2011 directing payment of gratuity in favour of the petitioner herein. Subsequently, the show cause notice was issued by the Controlling authority to the Company and a requisition for a certificate was issued to the Certificate Officer, Sreerampur, Hooghly. The Certificate Officer, Sreerampur, Hooghly initiated the proceeding on 17.10.2012 and since then no action has been taken by the Certificate Officer. Accordingly, in the interest of justice, the writ application is disposed of with the direction that the Certificate Officer, Sreerampur, Hooghly shall

take all necessary steps to complete the Certificate proceeding for recovery of gratuity within a period of 60 days from the date of communication of this order in accordance with law.

Let a copy of this order be sent to the Certificate Officer, Sreerampur, Hooghly, the District Magistrate, Hooghly and the Labour Commissioner, Government of West Bengal for compliance.

The writ application stands disposed of.

Pending applications stands disposed of.

Interim order, if any, stands vacated.

8.

Urgent Xerox certified copies of this order, if applied for, shall be supplied to the learned counsel for the parties as expeditiously as possible, in compliance of usual formalities.
