Case No. 1040 of 2019 under section 138 of the N.I. Act is progressing before the ld. JM, 4th Court, Purba Bardhaman.

The petitioner is the complainant and it has been brought to the notice of the court that till date the mode and manner of appearance of the accused persons are yet to be decided and the examination under section 251 of the cr.p.c. has not been done.

The next date has been fixed by the ld. trial court on 8.1.2024.

Accordingly, I direct that the ld. Magistrate would, on the next date or within a fortnight thereafter, conclude the process relating to Section 251 of the cr.p.c. and thereafter fix at least one date in every 60 days so that the trial of the case can be taken to its logical conclusion within a

reasonable period of time. No unnecessary adjournment be granted to any of the parties. All efforts be taken by the ld. trial court as also the contesting parties to conclude the trial at the earliest.

With the aforesaid observations, CRR 4982 of 2023 is disposed of.

Pending application (s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court at Calcutta.
