Petitioner is aggrieved by the inaction of the police 04.03.2025 Court No. 35 Item No.10 Rakib authorities and to that effect furnished representation and inspite of the same no action has been taken. Learned advocate for the petitioner has drawn the attention of the Court to page 69 of the writ petition which is the injury report and subsequently a representation which was made to the Officer-in-Charge, Dumdum Police Station in respect of the threats of the private respondents for withdrawal of the case before the Consumer Disputes Redressal Commission, West Bengal. State has submitted a report which reflects that the police authorities have exercised due diligence, however, the incident complained of according to the police authorities are Civil in nature and are pending adjudication before the State Consumer Disputes Redressal Commission, Bench-III, West Bengal. In view of the nature of the representation made before the police authorities which is for the purpose of the apprehension and expressing anxiety of the petitioner

that the private respondents are compelling to withdraw the case, I direct the police authorities would ensure that no breach of the peace and/or tranquility and/or any untoward incident results at the behest of either by the parties.

The injury report referred to by the petitioner is of the year 2018. Accordingly, if the petitioner intends to complain regarding the inaction of the police authorities in reference to the injury report, petitioner be well advised to approach the jurisdictional Magistrate with appropriate prayers.

With the aforesaid observations WPA 29038 of 2023 is disposed of.

Report so submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate for the petitioner.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
