1. In this public interest litigation, it is alleged that the private respondent, who was working as a primary school teacher has availed a job under the M.G.N.R.E.G. Scheme and, therefore, it is submitted that action should be initiated against him.

2. The Block Development Officer, Nandakumar Development Block has given written instruction dated January 6, 2025 from which it is seen that the job card was issued to Barun Das/private respondent on December 26, 2009, whereas his appointment as a primary school teacher was on December 16, 2012.

3. Apart from that it is submitted that the wages of Rs.2,880/-, which was deposited in the private respondent's account has been re-deposited in the district account.

4. Learned advocate appearing for the private respondent submitted that he had never applied for any job under the said scheme and it is a mistake and as soon as the

amount got credited in his bank account, he has returned the same.

5. In any event, the job card was issued much prior to the private respondent being appointed as a primary school teacher.

6. Hence, no action need be initiated on the representation given by the writ petitioner.

7. Accordingly, writ petition stands dismissed.

8. The authorities are directed to delete the job card, which is stated to be displayed in the website as on date. Such deletion shall take place within ten days from the date of receipt of server copy of this order.

9. No costs.

10. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
