Heard learned counsels for the parties.

The petitioner is the owner of the premises in question and the private respondent is a tenant under her therein.

The petitioner alleges that the private respondent has been indulging in online gambling portal associated with monetary transaction illegally. The petitioner lodged a complaint before the police authority which has not been acted upon.

The private respondent denies and disputes the allegations made on behalf of the petitioner and submits

that he invites several persons to join his gaming app and no monetary transaction is involved herein.

It appears from the reports submitted by the State that the cyber crime police station and the jurisdictional police have conducted enquiry pursuant to the complaint lodged by the petitioner. The cyber crime police station is still continuing the preliminary enquiry in order to identify the existence of the online gambling portal.

However, the jurisdictional police has reported that no such portal was found to be operated by the private respondent upon verification through YouTube app. The petitioner has not been able to produce any material evidence in support of his allegation.

The complaint of the petitioner has been diarized. Since the preliminary enquiry is being conducted by the Cyber Crime Police Station, the said authority is directed to hold such enquiry in a fair and impartial manner and take the same to its logical conclusion in accordance with law. No fruitful purpose shall be served by keeping the writ petition pending. The same is accordingly disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
