Affidavit of service filed in Court today is taken on record. However, the unserved writ petition is returned to the learned advocate appearing on behalf of the petitioners by retaining the unserved envelope. 2.
The petitioners are aggrieved by the steps taken by the Public Works Department under the West Bengal Highways Act, 1964. An objection filed by the petitioners is annexed at pages 82 to 85 of the writ petition.

It appears that the impugned notice was issued in the year 2023. According to the petitioners, no steps were taken by the authority after issuance of notice under Section 10(1) of the Act.

None appears on behalf of the respondents.
In the absence of the respondents it is not possible for the Court to decide the issue conclusively.

In view of the above, the instant writ petition is disposed of by directing the Executive Engineer, Public Works Directorate the respondent no.4 herein to take a decision on the objection filed by the petitioners
strictly in accordance with law, at the earliest but positively within a period of twelve weeks from the date of communication of this order.

Reasonable opportunity of hearing shall be granted to all the necessary parties prior to final disposal of the representation.

Learned advocate appearing on behalf of the petitioners is directed to forward a copy of the objection along with all supporting documents to the aforesaid respondents at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
