The husband of the petitioner was an Assistant Teacher, who retired on superannuation on 31st August, 2018. Due to superannuation of the husband of the petitioner, first Pension Payment Order was issued on 20th August, 2018, thereby retiral dues including pension were released in favour of the husband of the petitioner. Due to revision of pay as per ROPA 2019 revised Pension Payment Order was subsequently issued on 31st December, 2021. Thereafter, husband of the petitioner died on 20th May, 2023. Petitioner being widow of the deceased teacher prays for interest on revised gratuity due to delayed payment.

State respondents are represented by learned advocate.

Accordingly, the Director of Pension Provident Fund and Group Insurance and the concerned Treasury Officer are directed to release interest at the rate of 8% per annum to petitioner on revised gratuity as per revised pension payment order from 14th February, 2020 till the date of release of the revised gratuity amount, within a period of eight weeks from the date of communication of this order.

Since no affidavit is called for, the allegation contained in the writ petition are deemed not to have been admitted.

With the above observation, the writ petition stands disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
