Learned advocate appearing for the petitioner submits that petitioner has been implicated in this case because of his dues not being recovered and the son of the petitioner purchased the motorcycle for which he did not pay.

Learned advocate for the State has produced the Case Diary and draws the attention of the Court particularly, the statement of the victim under Section 183 of BNSS.

Having considered the same and the fact that one of the accused persons is absconding, at this stage, I am not inclined to release the petitioner on bail.

Accordingly, the prayer for bail of the petitioner in CRM (M) 37 of 2026 is rejected.

Case Diary be returned to the learned advocate for the State. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
