The petitioner is a Sub-Inspector of Schools in the West Bengal Subordinate Education Service (Inspection Branch). He is aggrieved by the fact that a request made to the Commissioner of School Education, West Bengal to permit him to join service after absence from 8th March, 2021 till 15th February, 2023, has not been so considered.

The petitioner made a representation on 27th August, 2023. It appears from the records that a Medical Board was constituted by the Secretary, School Education Department.

In those circumstances, the Commissioner of School Education shall consider the writ petitioner's representation dated 27th August, 2023 strictly in accordance with law and applicable rules and dispose of the same within a period of one month from the date of receipt of a copy of this order along with a copy of the writ petition.

This Court in the special facts and circumstances of this case, does not wish to remit the matter to the State Administrative Tribunal.

With the aforesaid directions, the writ petition is disposed of.

6.

There shall be no order as to costs.

7.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
