Heard the learned Counsel appearing on behalf of the petitioner and the learned Counsel for the State. Perused the case diary.

The petitioner prays for bail on the ground of long detention in custody.

On hearing the learned Counsel for the State and on perusal of the materials on record, it appears that the recovery in the present case has been made at Sonali Lodge and from the possession of the petitioner at the said Lodge. 4.

Admittedly, the petitioner is in custody for about one year five months.

It also appears from the case diary that 41 kilograms of Ganja was recovered from his possession and trial in the present case has commenced and two witnesses out of eight witnesses have been examined.

Considering the nature of the allegations and the long detention of the present petitioner in the custody, this Court

is inclined to grant bail to the petitioner as no further purpose will be served by detaining him in custody. 7.

Accordingly, the petitioner, Enamul Haque Mondal, shall be released on bail upon furnishing a bond of Rs. 20,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Judge, Bench-1, NDPS Act, City Sessions Court, Calcutta, subject to the condition that the petitioner shall appear before the Trial Court on every date of hearing and shall not intimidate witnesses or tamper with evidence in any manner whatsoever and on further condition that he shall not leave the jurisdiction of the Trial Court and shall provide a local address and mobile number of the Investigating Officer of the case as well the Trial Court and shall not leave the said jurisdiction without prior permission of the Court in case of emergency.

In the event he fails to appear before the Trial Court without any justifiable cause, the Trial Court shall be at liberty to cancel his bail automatically without reference to this Court.

The application being C.R.M.(NDPS) 1744 of 2025 is disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of necessary formalities.
