Learned advocate appearing for the petitioners submits that they were initially arrested on charges of recovery of 7 kg 509 grams of heroin. However, the investigating agency on conclusion of investigation did not submit the charge-sheet under the provisions of NDPS Act but has submitted chargesheet under the Drugs and Cosmetics Act. Learned advocate for the State has produced the Case Diary.

I have considered the report of the CFSL which reflects that no narcotic and psychotropic substances have been detected in the materials which were sent by the investigating agency for assessment of the contraband.

Having considered the period of detention of the present petitioners and the report of the Chemical Examiner, I am inclined to release the petitioners on bail. Accordingly, the prayer for bail of the petitioners is allowed. As such, petitioners namely, Sirajul Sk @ Heba and Abdulla Sk @ Babu shall be released on bail upon furnishing bond of Rs. 20,000/- (Rupees Twenty Thousand only) each, with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court under NDPS Act, Krishnanagar, Nadia.

If on bail, the petitioners shall be physically present on each and every date before the learned trial Court in seisin of the case and shall not leave the jurisdiction of district of Nadia without the prior permission of the learned Special Court. Accordingly, the application for bail being CRM (NDPS) No. 14 of 2026 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
