The petitioners are directed to deposit the deficit court fees within 21st March, 2025 failing which the writ petition shall be treated to have been filed only in respect of petitioner no. 1.

The petitioners claim to be the employees engaged through contractors and are continuously performing the duties assigned to them which are mostly in nature of 'Group -D Staff'. The petitioners are seeking regularization and absorption in the Railways. A bunch of similar matters were referred to the appropriate Government being the Central Government for being looked into.

Chief Labour

Commissioner (Central), Kolkata had prepared a final report on 13th September, 2022 after considering the report submitted by the Regional Labour Commissioner (Central), Kolkata and had made certain recommendations.

The said report dated 13th September, 2022 fell for consideration before a Division Bench of this Court. The Hon'ble Division Bench by an order date 20th February, 2024 directed for constitution of a body under the aegis of the Chairman, Railway Board for considering the grievances of the appellants in the context of the report dated 13th September, 2022 in order to take a conscious decision keeping in mind the nature of applicable labour legislation. The case of the petitioners, as appears from the records, has been considered by the Dy. Chief Labour Commissioner (Central), Kolkata.

Keeping in line with the order passed by the Division Bench on 20th February, 2024, the case of the petitioners be considered by the body to be constituted by the Chairman, Railway Board or by any existing body so constituted in terms of order of the Division Bench dated 20th February, 2024, if the same is still functional.

Nothing further remains to be adjudicated in this writ petition. The same is accordingly disposed of. (Arindam Mukherjee, J.)
