Learned advocate appearing for the petitioner is aggrieved that the police authorities were inactive in spite of the communication made on 21.08.2023.

As none appears on behalf of the State, Mr.

Sankha Prasad Roy, learned advocate who ordinary appears on behalf of the State is directed to represent the State. His appearance may be regularized by the concerned authorities.

Learned advocate for the private respondent submits that the crux of the communication was based on the learned Executive Magistrate's order which has subsequently become infructuous.

Learned advocate for the respondent disputes the contentions advanced in the writ petition and submits that the information furnished to the police authorities were infructuous, as such police authorities did not act upon the same. Having considered that the representation was made on 21.08.2023 and more than one and a half years have passed, I am of the view none of the orders of the Executive Magistrates are binding on the administration.

Petitioner if is aggrieved because of inconveniences faced by him in respect of his property will file a fresh representation before the Officer-in-charge of the local police station who will consider the same in accordance with law.

With the aforesaid observations WPA 29090 of 2023 is disposed of.
