Mr. Debajyoti Deb Mr. Tamal Ghosh Ms Somdyati Parekh ....For the petitioners Mr. Sirsanya Bandopadhyay Mr. Ritesh Ganguly ...For the State Challenging an order dated 26th November, 2024 passed by the concerned authority for imposing of a fine of Rs. 7,76,771/- (rupees Seven lakhs seventy six thousand and seven hundred seventy one), the instant writ petition has been preferred.

The learned counsel appearing on behalf of the petitioner fairly submits that there is an appellate authority against the order of the concerned SCFS. It is also submission of the learned counsel for the petitioner that he may be given a liberty to approach the appellate authority i.e. District Controller, Food and Supply, South 24 parganas being the respondent no. 3 of this matter so that, his grievances may be redressed properly.

Considering the fair submission on behalf of the petitioner, the instant writ petition is disposed of with a direction upon the concerned District Controller, Food

& Supply (respondent no. 3) to accept the proposed appeal of the petitioner, if preferred within two weeks from date and shall dispose of the appeal according to the provision of law within 6 weeks thereafter by giving a reasonable opportunity of being heard to the petitioner.

Respondent no. 3 shall intimate the order of appeal to the parties within two weeks.

If the appeal is preferred within a stipulated period as mentioned here in above, the delay in preferring the appeal should be condoned according to the provision of Section 14 of the Limitation Act. Under the above observation, the instant writ petition is disposed of.
