Learned counsel for the petitioners submits that the private respondents who are co-sharers of the land in question are restraining them from cultivating the land. Learned counsel refers to the record of rights in respect of the land which indicates that the predecessor in interest of the petitioners is possessing 16 decimals of land.
Learned counsel for the private respondents submits that though the petitioners claim possession in respect of 55 decimals of land, the record of rights suggests that they are in possession of 16 decimals only. The recent L.R. record of rights indicates that they are in possession of 6 decimals of land.
Upon consideration of the submission made on behalf of the parties, this Court is of the view that the land in question is undivided. Since both the parties are co-sharers in respect of the same, the petitioners are at
liberty to approach the appropriate civil forum for redressal of their grievance.
In the meantime, the police authority shall keep strict vigil in the area in order to avoid any untoward incident in view of the strained relationship between the parties and shall also ensure maintenance of peace and tranquility. Since the petitioners apprehend threat and assault at the behest of the private respondents, the police shall also render necessary assistance/protection to the petitioners as and when sought.
The writ petition is accordingly disposed of. There shall be no order as to costs.
Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
