Affidavit of service filed on behalf of the petitioner is taken on record.

No one appears on behalf of the School although the State is represented.

Learned counsel appearing on behalf of the petitioner submits as follows. It appears from the affidavit of service that the notice sent to the school returned unserved with the endorsement "door locked". The petitioner had prayed for general transfer on the ground of ill health of the mother of the petitioner and on the ground that he has to take care of his two minor children. However, his representation was not considered even by the school authorities.

Learned counsel appearing on behalf of the State submits that first the school has to forward the relevant papers to the concerned DI.

It appears that an application for general transfer is pending before the school authorities. It is only after the school

authorities forward the same before the DI that a decision can be taken in this regard.

In view of the above, let the school authorities forward the representation/application for transfer along with relevant papers to the concerned DI within four weeks from this date. Within a period of four weeks from forwarding of such document to the DI, the concerned DI shall take a decision on whether to allow the prayer for transfer of the petitioner and within a week thereafter, the DI shall intimate the petitioner about the outcome.

It is clarified that the merits of the case have not been gone into.

With these observations, the writ petition is disposed of. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
