Learned advocate appearing for the petitioner submits that petitioner is in custody for 10 months 18 days and is similarly situated as the other accused persons namely, Jamat Ali Mondal who has been granted bail.

Learned advocate for the State has drawn the attention of the evidence of Musa Karim Mondal.

Prima facie, from the evidence, it is reflects that there was certain overt acts of the present petitioner which distinguish him from the accused who has been granted bail in CRM (M) 1837 of 2025.

Having regard to the materials appearing against the present petitioner, I am not inclined to release the petitioner on bail.

Accordingly, the prayer for bail of the petitioner in CRM (M) 44 of 2026 is dismissed.
