The petitioner claims promotional benefits pursuant to the orders of the Hon'ble Supreme Court of India. Such benefits have been allowed by the respondents in their order dated 16th March, 2021. 3.

The petitioner claims revision of his pensionary benefits based on the notional promotion allowed to him in the aforesaid order.

This Court is of the view that since the petitioner is holding a service under the State, he ought to approach the State Administrative Tribunal with his cause of action.

5.

In those circumstances, W.P.A. No. 29105 of 2023 shall stand dismissed with liberty reserved to the writ petitioner to approach the State Administrative Tribunal.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
