Affidavit-of-service filed on behalf of the petitioner is taken on record.

By the present writ petition, the petitioner seeks direction upon the respondent authorities to regularise the petitioner's engagement in the post of Gram Panchayat Karmee in terms of Government Circular dated 8th October, 2003 and to consider and dispose of the representation of the petitioner dated 24th June, 2022 (Annexure P-4).

The petitioner contends that he was engaged as casual Gram Panchayat Karmee in Itkhola Gram Panchayat on 2nd July, 1991 by the then Pradhan of the said gram panchayat on the basis of a resolution taken in a general body meeting on 23rd June, 1991 against the sanctioned vacant post. Since then the petitioner has satisfactorily discharged his function as

Gram Panchayat Karmee with due diligence. The petitioner performed his duties at least 240 days per year, however the petitioner has not been regularised in the post of Gram Panchayat Karmee. The petitioner made a representation for regularization of his employment in the said gram panchayat as Gram Panchayat Karmee. Since no steps have been taken, hence this writ petition.

Mr. Lakshi Nath Bhattacharya, learned Advocate for the petitioner submits that the respondent No.7 be directed to consider and dispose of the representation of the petitioner dated 24th June, 2022 in the light of the Circular dated 8th October, 2003.

Mr. Gourav Das, learned Advocate for the State also submits that the matter be relegated to the respondent No.7 to consider the representation of the petitioner.

In view of such submissions, the writ petition being WPA 29109 of 2023 is disposed of directing the respondent No.7, the District Panchayat and Rural Development Officer, South 24-Parganas to consider and dispose of the representation of the petitioner dated 24th June, 2022 by a reasoned order in accordance with law, upon notice and hearing the petitioner, within a period of four weeks from the date of communication of this order.

Reasoned order shall be communicated to the petitioner within a week of passing thereof.

The learned Advocate for the petitioner is directed to communicate this order to the respondent No.7, District Panchayat and Rural Development Officer, South 24-Parganas along with copy of the representation dated 24th June, 2022 for necessary compliance.

It is made clear that this Court has not gone into the merits of this writ petition.

Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.

Interim order, if any, stands vacated.

All connected applications, if any, stand disposed of.

There shall be no order as to costs.

All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.

Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
