Case No.217/2025 arising out of Farakka Police Station Case No.464/2025 dated 30.11.2025 under Sections 20(b)/21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. In the matter of : Hriday Saha @ Mintu .... Petitioner Mr. Tapodip Gupta Mr. Suman Bhanja Mr. Golam Ahammed ...for the Petitioner Mr. Debasish Roy, Ld. PP Mr. Kunal Ganguly ...for the State Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits that there are no incriminating materials available against the petitioner except for the statement of the coaccused, which is inadmissible in evidence. Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. He submits that as per the report filled by the Investigating Officer, there is a criminal antecedent of the petitioner involving offences under the NDPS Act. Moreover, there are CDR records of

phone calls between the petitioner and the principal accused.

In view of the above and considering the other materials available in the case diary and the restrictions contained in Section 37 of the NDPS Act, I do not consider this is to be a fit case for granting anticipatory bail.

The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
