Petitioner v. State Of West Bengal And ANR
02.02.2026 Sl. No.60 NB CRM (A) 100 of 2026 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with English Bazar PS Case No.1881/2025 dated 26.08.2025 under Sections 126(2)/118(1)/3(5) of the BNS, 2023 read with Section 06 of the POCSO Act and 9/10/11 of Provision of Child Marriage Act. And In the matter of: XXX ... petitioner Mr. Abhishek Chakraborty, Mr. Musharaf Alam Sheikh.
...for the petitioner.
Mr. Anwar Hossain, Mr. Md. Yaser Ammar Ismail.
..for the State.
Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner has been falsely implicated in this case. She is the mother in law of the alleged victim. The marriage took place 5 years ago. The father in law has been granted bail by this Court.
Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. He submits that as per the victim's statement made before the learned Magistrate, the victim was kidnapped and given him marriage when she was only 14 years old. Thereafter, there was torture and assault inflicted on the victim. In fact, there was an attempt to set her on fire. She suffered burn injuries and in this regard reliance is placed on medical reports especially, at page 20 of the case diary.
Considering the above and the other incriminating materials available in the case diary, I do not consider this to be a fit case for granting anticipatory bail.
The application for anticipatory bail is, thus, rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
