sk The writ petitioner is the officiating Headmaster of a School, who considering himself eligible to be permanently absorbed as the regular Headmaster of the Schools and to that effect he has made a representation before the respondent/District Inspector of Schools, Secondary Education, Darjeeling dated November 14, 2017.

The same is yet to be attended by the concerned respondent.

Mr. Bari who is appearing for the writ petitioner submits that the writ petitioner's prayer may be considered by the concerned respondent authority in case the vacancy in the post of the Headmaster of the School still is available.

None is appearing for the respondent/State.

Considering the facts and circumstances of the present case, the same is taken up for order in absence of the respondent.

The concerned respondent/District Inspector of Schools, Secondary Education, Darjeeling is directed to consider petitioner's representation dated November 14, and pass an appropriate reasoned order

considering his eligibility and the vacancy position of the concerned post.

In doing so the respondent may afford opportunity of hearing to the writ petitioner, if it is found necessary by him.

The concerned respondent/District Inspector of Schools, Secondary Education, Darjeeling shall dispose of writ petitioner's prayer vide letter dated November 14, 2017 within a period of three weeks from the date of communication of this order.

The application along with writ petition is disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all formalities.
