Parties are represented through their respective learned counsels.

The principal argument of the learned advocate for the petitioners is based on Regulation 5 of West Bengal Council of Higher Secondary Education (Examination) Regulations, 2024. It is submitted that as per said regulation, ordinarily semester III examination of Class XII will be conducted within the month of September and the subsequent semester IV examination will be conducted in the month of April. Although
semester III had taken place in September 2025, the examination authority is conducting the semester IV in the month of February 2026, which runs contrary to Regulation 5.

Learned advocate for the respondent nos.2 to 4 placed reliance on a recent order passed in December 5, 2025 in WPA(P) 504 of 2025 and contended that the examination/semester schedule was issued way back on 07.05.2025 (Annexure P2). The said schedule/time table makes it clear that in May 2025 itself it was made clear that examination schedule will contain dates in February 2026. At this stage when examinations are scheduled nearby, interference may be declined and this course was adopted by this Court in previous case, being WPA(P) 504 of 2025.

We have heard the parties at length. We find substance in the argument of learned advocate for the respondent nos.2 to 4. In the previous order we have considered the Regulation 5 and notice dated 7.5.2025 (Annexure P2) and opined that the said notice was issued way back in May 2025 and, therefore, at this stage, we are not inclined to disturb the examination process and we find no reason to deviate from said order.
Accordingly, for the reasons state above, this PIL is dismissed.
