1. The petitioner is the son of late Pulin Behari Jana, who was an Assistant Teacher. He is 94 per cent disabled and has applied for pension as physically disabled dependent heir of his father.

2. Upon receipt of the petitioner's application, the case has been sent to the CMOH, Purba Medinipur by the D.I. of Schools (Primary), Purba Medinipur. The matter has not moved since then.

3. It is also submitted that CMOH, Purba Medinipur has communicated medical condition of the petitioner to the D.I. of Schools (Primary), Purba Medinipur and has confirmed the same.

4. In that view of the matter, the D.I. of Schools (Primary), Purba Medinipur is directed to take decision in the matter and communicate the same to the petitioner as well as the DPPG positively

within a period of one month from date. If the DPPG receives appropriate clearance from the D.I. of Schools (Primary), Purba Medinipur, let Pension Payment Order be issued to the petitioner and arrears be paid within a period of one month thereafter.

5. The writ petition is disposed of.

6. There will be no order as to costs.

7. All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
