The petitioner alleges police inaction stating that private respondent nos. 7 and 8 have not yet been arrested by the Investigating Agency in connection with the Andal Police Station case no.331/2023 dated 08.09.2023 under Sections 341, 324, 307 and 34 of the Indian Penal Code. The instruction filed by the Officer in Charge of Andal Police Station, Paschim Bardhaman suggests that initially a warrant of arrest was issued by the learned Magistrate against respondent nos.7 and 8. Proclamation order was also subsequently executed. Ultimately, a charge sheet had been filed against respondent nos. 7 and 8 along with the other accused persons.

In view of the above, it can not be said that there has

been any inaction on the part of police.

Accordingly, WPA 29115 of 2023 is disposed of. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Kausik Chanda, J.)
