1. Learned senior counsel appearing for the petitioners submits as follows. The accused no. 6, Ajit kumar Das was a Director of the company in question. He had allegedly taken money from the de-facto complainant for this company. The petitioners are also victims. The petitioner no. 1 had filed a complaint against the said accused. Incidentally, the de-facto complainant has also filed a civil suit in this regard.

2. Learned counsel appearing for the State relies on a progress report, which is taken on record. She also opposes the prayer for anticipatory bail. She submits that in this case the said accused no. 6, Ajit Kumar Das is the principal accused. It is alleged that he had taken money from different individuals by promising high returns. There are bank transactions which show that

some money was taken out of the account of the concern and transferred to a joint account belonging to the said Ajit Kumar Das and the petitioner no. 1. Apart from that there is no other incriminating material available against the petitioners as of now.

3. It appears that the principal accused is the accused no. 6 namely, Ajit Kumar Das.

4. Considering the above and the other materials available in the case diary and the alleged roles ascribed to the petitioners, I do not think that custodial interrogation of the petitioners is required in this case and I am inclined to grant anticipatory bail to the petitioners.

In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to further conditions that the petitioners shall cooperate with the investigation and shall not threaten or intimidate the witnesses. The petitioners shall meet the I.O once a month till submission of report in final form.

6. Accordingly, the application for anticipatory bail is allowed.

7. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
