Petitioners being the mother and father respectively complain that they are subjected to assault by the son and the daughter-in-law. To that effect, Maheshtala P.S. Case No.332 of 2023 dated 26.06.2023 was registered for investigation and on completion of investigation charge-sheet has been submitted before the jurisdictional court. Another case was registered on the basis of the direction passed by the learned Magistrate which was Maheshtala Police Station Case No.390 of 2023 dated 24.07.2023 and on completion of investigation charge-sheet has been submitted.
Having considered that there is a family feud and the petitioners being senior citizens are entitled to relief under the relevant provisions of the Maintenance of Welfare of Parents and Senior Citizen Act, 2007, petitioners would be at liberty to approach
the Sub-Divisional Officer having jurisdiction for necessary reliefs under the said Act.
Further, as two criminal cases are pending, petitioners would be at liberty to approach the jurisdictional Magistrate for necessary reliefs as it has been submitted before this Court that the petitioners being senior citizens are subjected to severe insecurity because of the overt acts being inflicted by the private respondents who happen to be the son and the daughter-in-law. In case such an application is filed before the Sub-Divisional Officer or the jurisdictional court which is in seisin of the criminal cases, the said court would dispose of the application preferably within a period of three weeks from the date of filing of such application.
With the aforesaid observations, WPA 30612 of 2024 is disposed of.
There will be no order as to costs.
Report so submitted be kept with the record.
