Petitioner is aggrieved by the fact that although the accused persons were involved in cutting down trees on the plot of land belonging to the petitioner yet appropriate sections under the relevant provisions of law have not been incorporated by the police authorities while registering Pingla P.S. Case No.239 of 2024.

Mr. Samanta, learned advocate appearing on behalf of the State has drawn the attention of the Court to a report enclosing a communication made by the Forest Range Officer which reflects that permit was granted.

In view of the documents relied upon by the State at this stage this Court is not in a position to

interfere. If the petitioner is in possession of better information and documents, he will be at liberty to bring the same to the notice of the learned Magistrate in seisin of the case.

With the aforesaid observations, WPA 30712 of 2024 is disposed of.

There will be no order as to costs.

Report so submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
